The latest version of ENDA no longer includes “gender identity” as a protected class and contains a broader exception for religious institutions. However, the legislation still recognizes “real or perceived sexual orientation” as a protected class and adds a two-part test that religious organizations must pass in order to have their beliefs on sexual morality protected. Furthermore, the legislation still burdens businesses with unnecessary regulation which could cause a litigious nightmare and harm work force morale.
